Step 1 be sure to attach a legible copy of your citation, fill out an application for a formal review and pay $25 fee to DHSMV within 10 days of your DUI arrest

Step 2 fill out a pre hearing statement within 10 days of DHSMV receiving your request for a formal review (step 1). List in the document any officers that you want to subpoena. Date and fill in the address at the bottom.

Step 3 You are not required to subpoena witnesses for a review hearing. If you decide to subpoena a witness you would have to add the hearing date, time, location, hearing officer or supervisor, individual to be subpoenaed, address, agency they work for, driver's name, DL number and citation number. If the subpoena is mailed in with the pre-hearing statement a self-addressed stamped envelope is requested by DHSMV.
